When companies temporarily post employees to France, legal regulations and a structured process must be observed. 1. Determine the country of sending:
- Home country remains the country of posting if employees work temporarily in France and continue to have social insurance there.
2. Prepare documents:
- Prepare necessary documents, including employment contract, social security certificate in the home country, proof of salary and working hours, travel and residence documents.
3. Submit a PWD report:
- Electronic submission to the French Labour Inspectorate via the SIPSI portal.
- Submit at least 48 hours before work starts.
4. Get proof:
- After successful submission, the employer receives a confirmation, which must be kept while working in France.
5. Comply with employment and social security regulations:
- While working in France, both employer and employee must comply with all applicable employment and social security regulations, including payment of social security contributions.
Note: It is important to note that filing the PWD notification is only part of the legal requirements for posting workers in France. Other rules and regulations must also be observed, in particular with regard to tax liability and local working conditions.
